TERMS AND CONDITIONS

Welcome to wonderphotoshop.ph (the “Site”), the official e-commerce site of Wonder Photo Shop. Please read the listed terms and conditions carefully. By accessing the Site, the User agrees to be bound by these Terms and Conditions. If User do not agree to these Terms and Conditions, do not access and/or use this Site.

The Wonder Photo Shop website is operated by YKL Color Inc. (“Operator”), an authorized distributor of FUJIFILM Philippines Inc. (“Stakeholder”), and authorized licensee of the “Wonder Photo Shop” trade name.

1. Definitions and Interpretation

1.1 “Site” means wonderphotoshop.ph, the official e-commerce website of Wonder Photo Shop.

1.2 “Operator” means YKL Color Inc, official distributor of FUJIFILM Philippines Inc., operator and licensee of the Wonder Photo Shop trade name.

1.3 “Stakeholder” means FUJIFILM Philippines Inc.

1.4 “Print items” means any order under the photofinishing and Deco print services of Wonder Photo Shop. This include photos printed on photo paper, cork, sintraboard, acrylic, etc.

1.5 “Instax products” means FUJIFILM instax cameras and films.

1.6 “X-Series products” means FUJIFILM X-series cameras and FUJINON lenses.

1.7 “Warranty Card” means the warranty card received from purchases for FUJIFILM instax cameras, X-series cameras, and FUJINON lenses.

 

2. Use of the Site

2.1 User must be at least 18 years of age to access the Site, otherwise he/she must be under the supervision of a parent or legal guardian.

2.2 Content provided on this site is solely for informational purposes. Product representations expressed on this Site is provided by FUJIFILM Philippines Inc. and YKL Color Inc.

2.3 Upon registration, User agrees to receive promotional emails from Wonder Photo Shop. User can opt out of the emails anytime by clicking on the link at the bottom of the sent promotional emails.

 

3. Customer submissions and information

3.1 Certain services and related features that are made available on the Site may require registration and submission of personal data. Should the User choose to register and/or subscribe for the available services and features, he/she then agree to provide accurate and current information about himself/herself.

3.2 Every User of the Site is responsible for keeping his/her own passwords and other account information safe and secure. The account owner is responsible for all the activities that go through the account or password.

3.3 For any instance of unauthorized use of the User’s site account, the User must notify Wonder Photo Shop customer service through (support@wonderphotoshop.ph). The Site, Stakeholder, and Operator shall not be responsible or liable in any way, for any loss or damage of any kind incurred as a result of, or related with, the User’s failure to comply with data security.

3.4 Text content that the User will submit and/or provide to the Site, including but not limited to questions, reviews, comments, and suggestions will become the property of the Site. Upon submitting, the User agrees to grant the Operator and Stakeholder the right to use the name submitted in connection to the questions, comments, and/or other contents.

3.5 Any photos uploaded and submitted to the Site will solely be used for processing and delivery of the Printing service. Upon submission of photo, the User agrees to let the Operator process the order as submitted in terms of size, resolution, and cropping. The User also complies and agrees to the following:

3.5.1 Due to the chance of color and density of each submitted photo varying from computer and smartphone calibrations, the Operator will only do a minor density alteration prior to printing the photo

3.5.2 The Operator and Stakeholder will not be liable for any loss of photos during the upload due to damaged file, internet connection, incomplete upload, and other related problems beyond their control.

3.6 Photo submitted by the User to the Site will be kept for 15 days in the Operator’s database to accommodate chance of returns and replacements. After 15 days, the photos will be deleted from the Operator’s database.

 

4. Order Acceptance

4.1 The User acknowledges that all orders are final after submission. No cancellation of orders will be accepted once the items have been checked out and payment has been made.

4.2 The User acknowledges that there are cases when an order cannot be processed for various reasons. The Operator reserves the right to refuse or cancel any order for any reason at any given time. The User may be asked to provide additional verifications or information, including but not limited to the User’s phone number and address, before the Operator accepts the order, subject to data privacy law.

 

5. Intellectual Property

5.1 Intellectual property related to the Site shall remain the Operator and the Stakeholder’s property. This may refer to the website design including, but not limited, to the promotions, text, graphics, photos, selection and arrangement, and all software compilations such as source code and software.

5.2 Restricted Use: No part or parts of the Site, or any materials found within, may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcasted, hyperlinked, mirrored, framed, transferred, or transmitted in any manner or by any means or stored in an information retrieval system or installed on any servers, system or equipment without prior written permission of Operator and the Stakeholders.

 

6. Warranty Policy for FUJIFILM products

6.1 For Instax and X-series purchases, all Warranty Cards will be named under the User’s registered name on the Site.

6.2 The User may needs to provide copy of Warranty Card and printed official receipt to claim warranty for repair or servicing of product.

6.3 FUJIFILM Warranty DOES NOT cover faults / damages that arise from the following:

6.3.1. Accidents

6.3.2. Inappropriate usage or damage due to external factors

6.3.3. Entry of liquids, vapour, dust, dirt, or other foreign objects into product

6.3.4. Corrosions due to liquid or battery

6.3.5. Wear and tear of product

6.3.6. Missing, defaced or alteration on product’s description such as model and serial number on product/Warranty Card/purchase receipt

6.3.7. Usage with third party’s products and inappropriate usage not in accordance to instructions stated in the FUJIFILM user’s manual or nu authorized personnel

6.3.8. Any attempted cleaning or repair by self or third part other than authorized personnel

6.3.9. Accessories such as batteries, adaptors, cables, connectors, storage media, CD ROM, battery charger, etc.

6.3. 10. Acts of God

6.4. All parts replaced will be part of the Stakeholder’s property.

 

7. Exchange Policy

7.1 Instax products and X-series products returns for replacement are accepted provided the following conditions are met:

7.1.1. The item to be replaced or returned is within 7 days from received date of the item.

7.1.2. The User must provide the order number, printed copy of the official receipt and Warranty Card. If the Warranty Card becomes void, tampered or has been removed, User must provide the serial number or model number.

7.1.3. The item and its packaging must be in good and without dents, scratches, cracks, tears, and other forms of damages rendering item as not replaceable.

7.1.4. If the item in question is found to be defective upon receipt, and defect/damage is due to the error of the Operator and/or its courier.

7.2. Print items may be returned and replaced provided under the following conditions:

7.2.1. The delivered prints are different from the User’s order, i.e. there were errors in printing in terms of size, paper type, or incomplete quantity.

7.2.2. The delivered prints do not belong to the user.

7.1. 8. The prints incurred damages due to mishandling during the delivery process.

7.3. Replacement for print items shall not be allowed if due to the following reasons:

7.3.1. The User is dissatisfied with the quality, i.e. pixelated, blurry, off-color, or wrong cropping. Refer to User submission clause 3.5 for your reference.

7.3.2. User decides to change order after photo submission. Refer clause 4.1.

 

8. Refund Policy

8.1 If the User opts for a refund instead of a replacement, the Operator will approve the refund provided the following conditions are met:

8.1.1. For instax and X-series products, refer to under Clause 7.1.

8.1.2. For print items, refer to Clause 7.2 and 7.3.

8.1.3. Refunds for credit card transaction are subject to the policies of the issuing bank.

 

9. Pick Up Policy

9.1. Customers have the option to choose Store-pick up and Door-to-door delivery. For Store pick-up items, the User can choose dates within 5 – 15 business days after the date of purchase.

9.2.1. Items for pick up will only be available at the branch of choice for 15 working days after the selected pick-up date.

9.2.2. If any item purchased from the website remains unclaimed after the specified 15 working days, the Customer must claim the said item in the main branch of the Operator in Sto. Domingo.

 

10. Delivery Policy

10.1.      All orders are subject to product availability from Wonder Photo Shop website (“the Site”). If an item is not in stock at the time the order is placed, the Operator will notify User and refund the total amount of order, using the original method of payment.

10.2.      Items offered in the Site are only available for delivery to addresses in the Philippines. Any shipments outside of the Philippines are not available at this time.

10.3.1    An estimated delivery time will be provided to the User once the order is placed. Delivery times are estimates and commence from the date of shipping, rather than the date of order. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order.

10.3.2    Unless there are exceptional circumstances, the Site makes every effort to fulfill the User’s order within 7 business days of the date of order. “Business day” means a day other than a Saturday, Sunday or public holiday in the Republic of the Philippines on which banks in the National Capital Region are open for general commercial business.

10.3.3    Please note the Site only process orders on business days and does not ship on weekends.

10.3.4    Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered. Products may also be delivered in partial shipments.

10.4.1    Shipping costs are based on the weight of the order and the delivery method. To find out how much the order will cost, the User must add the items to cart, and proceed to the checkout page. Once at the checkout screen, shipping charges will be displayed.

10.4.2    Sales tax is charged according to the province or territory to which the item is shipped.

10.5.      If there is any damage to the packaging on delivery, the User contact the Operator immediately at support@wonderphotoshop.ph

10.6.      For any questions about the delivery and shipment or order, the User can contact the Operator at info@wonderphotoshop.ph.

 

11. Coupon Redemption Policy

11.1 Coupons offered through the Site are non-refundable to cash.

11.2 Coupons offered through the Site can only be redeemed on the specified promo period in the collateral.

 

12. Termination

12.1        The Operator and Stakeholder reserve the right, without notice and in its discretion terminate the User’s ability to use the Site, and to block or prevent future access to and use of the Site. Failure by User to abide by the terms and conditions of the Site will automatically revoke his/her authorization to use the Site and its included services. The Operator and Stakeholders reserve the right to seek all remedies available at law and in equity for violations of these terms and conditions, including the right to block access from a particular Internet address to the Site.
